we're at the top of the park where there's still a thick layer of mud covering the area. again, they are going to be here in just a few hours. equipment is already in place for the second round of clean- up. the water main break caused a mess. clean-up crews were working well into the night to do as much as they can. you can see that thick layer of mud covering the roads in front of neighbors's homes. now, from above, our chopper 5 shows you just how far it extend out. this is what neighbors woke up to abruptly at 4:30 a.m. 12 homes were evacuated after 45,000 gallons of water caused that landslide. thankfully there were no damage to homes but neighbors say they are still worried about the safety of the hillside. >> hopefully there's nothing really going to happen at all especially with the rain coming this weekend. >> are you worried about that and the stability of the hill. >> better to update us as soon as possible. >> reporter: engineers tested the hill before allowing people back in their homes and city

officials say an 8" pipe connected to a water tank burst, causing the landslide. they blame the pipe's old age, that pipe was made in the 1930s. city officials plan to repair or restore the pipes in the area and say there could be more aging pipes similar to the one that burst yesterday. live in daly city, cate caugiran, cbs 5. >> thank you. big question now, who is going to pay for all the clean- up? car owners whose auto insurance policies do include a comprehensive coverage are automatically protected no matter where the car was parked. but you should make the claim immediately. drivers who don't have the comprehensive coverage should submit a claim to daly city within the next six months. forms are available at city hall. an attic fire in the east bay forced a family out of their home. one firefighter suffered minor injuries. crews took 20 minutes to knock the fire down. they spent hours dealing with the flare-ups.

that's due to complications from a new roof on the home. the residents inside smelled smoke before the alarms went off. san francisco city hall will be open for business today. this is a live look at city hall. it's running on a generator right now. pg&e crews are working to get powerfully restored there. and last night an electrical problem in the basement set off the smoke alarms forcing everyone inside to evacuate. the sprinklers went off causing minor damage inside. sierra lamar's accused killer facing new charges. 21-year-old antolin garcia torres is charged with three other kidnappings in 2009. sierra lamar disappeared this year. torres was arrested in may for her kidnapping and murder. her body hasn't been found. the first look at two men who police say kidnapped a woman threw her in the back of her own car and then drove her around from atm to atm.

cbs 5 reporter anne makovec in walnut creek with some new surveillance video just released and she is going to share it with us. >> reporter: it all started in the shade lands business park area of walnut creek. police say the woman kidnapped was in the wrong place at the wrong time. they have been getting tips overnight since they released new surveillance video yesterday afternoon but they are still looking for more tips. we want to show you these pictures one more time. surveillance video from one of the banks where the kidnappers tried to withdraw cash from the woman's account. the whole time she was tied up in the back of the car after about three hours they let her go in the oakland hills. the description we are looking at right now, two white men in their early 20s, one 5'9", one 5'11". the taller one possibly named david has broad shoulders, dark hair. the shorter one possibly named aubrey was skinny and is the guy that you saw in the photos. once they dropped the woman off in the oakland hills, they

drove away in a dark small colored or dark colored small pickup truck with a loud muffler. those are the clues. and with the pictures they are pretty clear, walnut creek police hope somebody will recognize at least one of the guys and if you do, of course, call the walnut creek police. anne makovec, cbs 5. let's check weather. i guess we should enjoy today because some changes are coming. >> but sunshine today, right? >> sunshine. and we should enjoy every day. >> true! >> i love the rain, too. but yeah, we do have some changes coming our way. outside right now, a few high clouds cruising overhead making for a beautiful start to the day but we are going to see plenty of sunshine and it looks like some very nice temperatures. probably the warmest of the week. 40s and 50s right now. and by the afternoon, that sunshine going to crank these temperatures up into the 70s. right now though high pressure still holding strong although a lot of clouds moving across the top of the ridge. by the afternoon, a lot of sunshine, just a couple of

passing clouds and temperatures even warmer than yesterday. yesterday wasn't bad. but today we are going to see a lot of 70s showing up about 70 degrees in concord. 70 in san francisco. and 72 in san jose. this is about as good as it gets though this week. we have some rain on the horizon. we'll talk more about that in a moment. right now let's check the roads with elizabeth. >> we are going to enjoy this dry commute while we can. we are following a couple of problems though. we are seeing in the usual amount of delays right -- an unusual amount of delays right now on westbound 4 because of an accident not even blocking lanes. it's off to the shoulder approaching a street lone tree way but unfortunately it's causing heavy traffic right now through antioch. also reports of an accident westbound 580 approaching santa rita, tassajara. we can't see it but we are seeing bunching up but we have delays stop and go from the altamont pass to the dublin interchange. the nimitz 880 through oakland near the oakland coliseum, no problems. 16 minutes between 238 and the maze. and a quick note for the south bay commute in san jose, they

have closed off that off-ramp from southbound 880 to the alameda for emergency roadwork a heads up until 11:15 a.m. when caltrans crews will hopefully fix the problem and reopen those on- and off-ramps in the area. that is "timesaver traffic" camera. back to you guys. >> thank you. the scandal involving two of the highest ranking military officials in the u.s. takes center stage on capitol hill today. susan mcginnis joins us from washington where lawmakers are now demanding answers. >> reporter: they are. hey, michelle. yeah, the list of questions including who knew what and why, why wasn't congress told sooner and was national security compromised? the sex scandal that brought down david petraeus and is now enveloping another top u.s. general moves to capitol hill today. house intelligence leaders will ask fbi deputy director sean

joyce and acting cia director michael morrell about the events that led to david petraeus' resignation as head of the spy agency. petreaus left the job when news of an affair with his biographer paula broadwell became public. >> did you have any indication that -- [ indiscernible ] >> reporter: tampa social ice jill kelley initiated the fbi investigation that led to david petraeus's resignation after receiving threatening e-mails linked to broadwell. kelly is connected to another general. america's top commander in afghanistan, general john allen. the pentagon is looking at more than 20,000 documents and e- mails between allen and kelley which some have labeled inappropriate and flirtatious. >> no one should leap to any conclusions. >> reporter: general allen's nomination to be the leader of u.s. forces european command and nato's supreme allied commander is in doubt. >> his nomination has been put on shoulder as a prudent

measure until we determine what the facts are. >> reporter: the white house says president obama still trusts general allen. >> he has faith in general allen, believes he is doing and has done an excellent job. >> reporter: general joseph dunford will replace general allen in afghanistan as soon as he is confirmed. the president holding a press conference at the white house in about 4.5 hours. he will most definitely face questions about the scandal including his plans for his national security team going forward. also when the white house and when he first got wind of this scandal. >> no kidding. you mentioned the president. what about the time of the scandal? it's a tough time for the president dealing with questions about the cliff and benghazi. >> reporter: lots of challenges overseas. now he has a distracted afghanistan commander. he has no permanent cia director and all of these international challenges including benghazi and including iraq and afghanistan. >> all right. well, live in washington, susan

mcginnis, thank you. and jill kelley has been calling police to complain about reporters and others who have lined up outside her home in tampa. in one call she seems to indicate her property is considered diplomatic soil. >> because i'm an honorary consul-general so i have inviolability so they should not be able to cross this property. i don't know if you want to get diplomatic protection involved, as well. >> tampa police say they have received at least five calls from kelley's home since sunday. president obama will likely talk about the scandal in a news conference set for today. he also plans to discuss the looming deadline for the democratic and republican leaders to reach a budget deal that's addressing the nation's debt. the president talked about it with labor leaders yesterday. fade he is going to get together with business -- today he is going to get together with business leaders including some from general electric, walmart and ford. cbs news will have a special report at 10:30 here on cbs 5. you can also watch the press

clip shows a baltimore bus driver brawling with a teen girl. according to the youte blame this fight on disrespect. this clip shows a baltimore bus driver brawling with a teenage girl. according to the youtube user, apparently the teen passenger upset the driver by playing her music too loudly. the fight ended up on youtube and the video -- you can hear the driver say, this was all about being disrespectful on her bus. the "baltimore sun" reports the driver has been suspended for the investigation. you better behave if you're on that bus. >> she is saying it's disrespectful and she fights her. >> she must have said something back. the search is on for stolen artifacts from the first smash and grab heist at a popular oakland museum. >> the museum's executive director says security guards watched the heist happen monday

from surveillance monitors. according to protocol, they called police but not before the burglars took off. museum workers say it may have been the work of copycats. >> there have been some high- profile museum thefts in recent months and years. and it may have emboldened peen. >> might be the inspiration of those guys that just stole all thepy cast so and everything. >> it's up because it is such a cultural mecca. >> police aren't saying what was stolen but they have arrested one suspect the museum is expected to reopen tomorrow. well, millions of toyota cars are being recalled all around the world including 670,000 here in the u.s. the recall involves the prius and other models produced since 2000. apparently there's a defect in the steering shaft that could cause steery problems. toyota is also recalling 630,000 cars because of a water pump problem so if you have a toyota, you might want to check it out. >> yeah. it's 6:15 right now. why don't we get a check on the roads. speaking of cars and toyotas. >> take away, liz.

>> good transition. let's go outside live towards the bay bridge because suddenly it looks a lot different in the last 15 minutes. it's because the metering lights are turned on. so we have delays in the cash and the fastrak lanes. a beautiful shot of the sun coming up, as well. but traffic unfortunately that doesn't look as good. that's stacking up beyond the first overcrossing. >> up the incline this is why they turned the metering lights on. a tight squeeze from treasure island. you can see some brake lights across the stretch at andrade with roadwork. high 4 just cleared the -- highway 4 just cleared an accident off the right-hand shoulder, westbound 4 at a street, lone tree way. delays continue through

antioch. past there speeds over 40 miles an hour. through pittsburg-bay point and concord. 880 in oakland busy but no delays from hayward towards downtown oakland. looks great for the simple sill commute. mass transit delay-free all morning systemwide for bart, ace, muni, caltrain and ferries. that's "timesaver traffic." here's lawrence with the traffic. >> a lot of sunshine and we are going to have high pressure strengthening. a lot of high clouds overhead out the door but should be a great day. warm temperatures, breezy in the hills. then this afternoon lots of sunshine and some mild to warm temperatures all the way to the coastline. but then the rain could make a return late thursday night into friday. high pressure sending motors of the rain well to the north

although we continue to see a few clouds in the skies. we'll do those on and off throughout the day today and then that ridge holding on before this system approaches the coastline. that one right there will likely bring some rain late thursday night into friday. but enjoy the day today. this will be the warmest day of the week with mid-70s in the hot spots. computer models show passing clouds throughout the day. clouds thicken up and late thursday night, here comes the rain into friday morning. some showers going to continue right through friday into saturday. and then a stronger storm system moves in it looks likes on late saturday night sunday morning. temperatures around the bay area today are going to be very nice. 72 in san jose. 70 in fremont. 6le degrees in pacifica. east bay numbers running well into the 70s in many spots. and inside the bay, 60s and 70s a gorgeous day to get out there and enjoy. and get ready we have some changes coming. tomorrow we'll notice clouds rolling in and then by friday we are expecting some rain on- and-off showers through saturday and then a stronger storm moves in on sunday into

monday. back to you. uc leaders are delaying the vote on raising student fees. the move comes after requests from governor brown. he questioned the timing of raising tuition a week after voters passed prop 30 to fund education. the uc system was look at raising fees by as much as 35%. yesterday cal state trustees also delayed a vote on a proposal to raise fees. well, some naked people are likely to show up on the steps of san francisco city hall at noon today. a protest is planned against a proposed ban on nudity in the city. a lawyer says she plans to take the case to federal court. she wants to block san francisco supervisors from voting next tuesday on the ban. >> i think lawrence should do his weather live from city hall steps today. >> i think so too at noon. great. >> it would be funny. 6:19. a judge in ohio plans to keep watch today over a woman serving a strange sentence. she was sentenced to two days

of standing on a street corner. she was supposed to hold the sign. her crime was caught on school bus tape. day after day she drove on a sidewalk to get around i school bus. well, the penalty was to carry that sign saying, only an idiot would do that. >> look at her, man! only an idiot would drive on the sidewalk. >> i hope [ indiscernible ] >> well, the judge will watch over hardin's second day of the sentence because on the first day, she spent time texting, talking on the phone, listening to music and sitting in her car. so she better straighten up. >> that's a good idea for a punishment. >> right. >> especially when you see that. >> you could fine someone but if you put them out there and kind of humiliate them and let them see the kids maybe she won't do it again. 6:20. coming up, now the nfl is getting very serious about concussions. >> plus, when it rains it pours. why another four star army general is in hot water this morning. ,,

players' union reportedly ws independent concussion specialists, to be on the sidelines of every game. it comes after four more pls suffered concussions sunday. nfl players union reportedly wants independent concussion specialists to be on the sidelines for all nfl games after four players had concussions this weekend including 49ers quarterback alex smith. he left the game against st. louis after experiencing blurred vision. he must be medically cleared before he plays again. he is seeking a second opinion. oakland as manager bob melvin cal grad good guy is the american league manager of the year. >> great. he is credited with guiding his team to a huge turnaround season in only his second year

clean it all up if not already, cate. good morning. >> reporter: good morning. they got most of it from the road but it's still thick mud in the park. look at the mess from yesterday. you can see that mud inches deep covering that road in front of neighbors' homes. that water main burst brought down that inches thick of muck, silt and dirt. the clean-up went well into the night in this daly city neighborhood. look from chopper 5, neighbors were startled at 4:30 a.m. when police told them to leave their homes after 45,000 gallons of water came downhill. city leaders say it was because of a cast iron pipe that broke and that was made in the 1930s. >> you can see the pipe sheared off. we have an aging system. we know we have pipes in the ground that are possibly, you know, close or past their useful life. that's not uncommon within any bay area community. >> reporter: no homes were damaged. about 12 families evacuated.

that leadership position. that is according to cbs new she has scheduled a news conference about a half hour from now. she wouldn't discuss it when asked by reporters -- she wouldn't discuss her future. she said she wanted to talk to her caucus first before announcing that. but there had been speculation that she would step down from the post. again, she is going to remain at that post and we're told that there were cheers outside the hallway when -- after she had announced that to her caucus. >> she has been in office for a long time. a lot of people thought she might step down but she is staying there. the red cross is trying to find shelter for an el sobrante family after a fire damaged their home of the the fire sent a firefighter to the hospital. he only had mine more injuries though. the residents inside smelled the smoke before their alarms even went off. fire caused at least $80,000 in damage. right now pg&e crews are trying to fully restore power on the 3rd and 4th floors of city city hall. these are live pictures at san francisco city hall. they will run on generator

power when it opens for business later today. last night an electrical problem in the basement set off the smoke alarms forcing everyone inside the building to evacuate. the sprinklers went off and caused some minor damage to be cleaned up. the man accused of killing morgan hill teenager sierra lamar is facing more charges. 21-year-old antolin garcia torres is being charged with three counts of attempted kidnapping during a carjacking. those date back to march of 2009. lamar disappeared in march of this year. torres was arrested in may for kidnapping and murder even though lamar's body has not been found. new video shows two kidnapping suspects who used the victim's car to hit up atm machines. cbs 5 reporter anne makovec is in walnut creek with the video and suspect descriptions. >> reporter: we are trying to get this information out there because the pictures are so clear. police think somebody might recognize them. this is where it started, here in walnut creek at this

business park in the shadelands area. police say this 57-year-old woman who was kidnapped was in the wrong place at the wrong time. now, here are the surveillance video pictures that they have been trying to circulate since yesterday. this is from one of the banks where the kidnappers tried to withdraw cash from the woman's account all while she was tied up in the back of her own car. after about 3 hours, they left her go in the oakland hills and she is okay. these guys are identified as white men both in their early 20s. now, one of them was 5'11", 185 pounds with broad shoulders wearing a black sipup collared shirt a t-shirt and jeans. the other guy was 5'9", skinny about 150 pounds, wearing a black hoodie and dark jeans. at one point he was wearing a mask. now, two names were bantered about in the car that night according to the woman. david and aubrey. and police don't know if those are these guys' real names or

[ laughter ] >> it should be very interesting. looks like we have some temperatures on the cool side in some of the north bay valleys again. 39 degrees in santa rosa. 45 in san jose. and 54 degrees in san francisco. still some high clouds drifting overhead but high pressure holding on those clouds drifting across the top of the ridge the rain line staying to the north for now but that's going to change as we look toward the next couple of days. outside probably the warmest

day of the week today. these temperatures yesterday still comfortable in the 60s. today we'll be up in the 70s. about 70 in san francisco. 72 in san jose. and 70 degrees in concord. rain is acoming. we'll tell you when in a moment. let's check the roads with elizabeth. >> even though it's dry a couple of accidents in the newsroom including one in daly city northbound 280 before highway 1 crash blocking one lane as well as in walnut creek southbound 680 by treat boulevard we have a car blocking the carpool lanes so just a heads up. no delay though right now on 24. all right. elsewhere, slow and go this morning from 205 out of tracy all the way through the altamont pass in livermore. that drive time almost a half hour now between the altamont pass and 680. it is in the red. elsewhere we just started to see slowing in the last few minutes on westbound 237 for the silicon valley commute leaving milpitas heading towards san jose. let's get a quick look at the bay bridge toll plaza. the metering lights are on now.

they have been on since about 6:15. so you're jammed up almost to the macarthur maze. that is traffic. back to you guys. >> thank you. three people are dead after the fiery crash of a single- engine plane in mississippi. the piper pa32 had just taken off from jackson when it crashed into a home yesterday. one person in that burning home escaped with minor injuries. no one else was hurt. the cause is still unclear. all three victims on board were pilots traveling to a federal aviation administration safety conference. an e.r. doctoof the year is accused of causing a dramatic crash in massachusetts. an suv comes out of a parking lot over a grassy area and crashes into that car. the impact pushed it into a truck in the next lane. dr. kristin howard is accused of driving under the influence of alcohol and drugs. >> wow. hearings are planned on

capitol hill today as member congress say two u.s. military generals owe them answers. lawmakers would like to determine if national security was threatened while former cia director david petraeus had an extramarital affair with biographer paula broadwell. she allegedly sent harassing e- mails to jill kelley, a woman she apparently saw as a romantic rival. investigators are looking into e-mails kelley sent to general john allen the top u.s. commander in afghanistan. now allen's quest to be commanders of the u.s. forces european command is in doubt. >> his nomination has been put on hold as a prudent measure until we determine what the facts are. >> general joseph dunford will replace general allen in afghanistan as soon as congress confirms him. yet another u.s. general in hot water, as well. general william kip ward is accused of spending thousands of dollars on lavish travel and unauthorized expenses. he has been demoted. he will retire as a three star

price delayed the commercial season until after thanksgiving. crabbers say then $3 a pound this year but buyers say they think $2.50 a pound is fair. new snow in the sierra has ski resorts opening for business a little early y heavenly mountain resort and so ski resorts are opening up today two days ahead of schedule. recent storms have dumped more than 3 feet of snow and many hope to see a boost in business for the thanksgiving holiday. can't wait to get out on the slopes. >> i know. you colorado girl, i haven't been up in the sierra yet? >> i have not. i'm excited for that. >> they are going to get a ton of snow with a series of snow headed our way. but not today. we have a lot of sunshine. in fact, outside what a gorgeous start to the day. live shot sun just about to coming up. our mount vaca cam looking so beautiful. high clouds movings across the skies and wow, making for a beautiful start to the day. still, we're expecting plenty of sunshine today as we head toward the afternoon and this probably is the warmest day of the week. and then we could see some rain

ashley morrison of cbsmoneywatch.com is in for jason brooks with an update. good morning. >> reporter: good morning. asian stocks got a lift overnight after greece held a sale of short term treasury bills on tuesday. the nikkei added a fraction breaking a seven-day losing streak white hong kong's hang seng gained 1%. a better-than-expected earnings report from sis so. the blue chip stock is rallying as much as 7% after cisco beat analyst estimates. the company saw a pickup in orders from large u.s. businesses that has been giving stocks a little bump on wall street. let's see how we're doing. the dow is up by 10 points. the nasdaq is climbing 15. and millions of shares of facebook could be looking for an investor to friend them on the stock market today. a lockup period on stock issued to the social networking company's first employees and investors ends today. now they can unload the stock that's lost nearly half of its value since facebook's ipo in

may when its stock was offered at $38 a share. we'll see a lot of defriending going on. >> i think you're right. hey, earlier this morning, you admitted to us that you are a big texter. >> reporter: yes, i am. and some people are saying it's going out of style but i say no way. according to one tech analyst people are texting less. for the first time, the number of monthly texts dropped slightly. on average, people send 675 texts a month of that's compared to the 700 they were sending earlier in the year. but it's not that people are communicating less but, instead of texting they are using apps like skype, google voice and facebook to get the services that also like apple's i message and blackberry's messenger but i have to say, yes, i'm a big texter. 675 sounded like a low number to me. >> that's only about 20 a day. how many do you do in a day? >> i don't know. and i don't think i want to look. i might need an intervention! [ laughter ] >> i wouldn't even count.

around the world. the recall involves the pris and other models produced se in the welcome back. millions of toyotas are being recalled and the world involving the prius and some other models produced since 2000. a defect in the steering shaft could cause steering problems of the 670,000 toyotas shoulder in the united states are included in the recall. toyota is also recalls the 630,000 cars because of a water pump problem. crews have more clean-up work today to get the mud out of daly city. we want to take a live look out at all of that mud. look at the mess. the mud that covered a main street trapped a number of people in their neighborhoods because their cars got stuck in it. the water came from a pipe that broke on a hill above the neighborhood that was hit. an 8" cast iron pipe from the 1930s broke. no hold were damaged. pg&e crews are trying to

restore power on the 3rd and 4th floors of san francisco city hall. this is a live look there. i believe you can hear the generator. they are going to run on generator power when it opens for business today. crews are trying to figure out what sparked an electrical problem in the basement last night. the sprinklers went off causing minor damage inside. the electrical wiring was installed in 1999 after the loma prieta earthquake. sources say that nancy pelosi intends to remain as house minority leader. the news comes despite democrats failing to gain the 25 seats needed to win the house majority. about 20 minutes ago a congressional official said mostly just broke the news -- pelosi just broke the news to her party caucus ahead of a news conference scheduled in a few minutes from now. this had been speculation she would step down from her post. last week she breezed to re- election in her heavily democratic san francisco district. but again she is going to remain. >> somebody leaked that in her
